Terms of Service

1. Service Description and Eligibility

Hexys is a pornography recovery application that provides streak tracking, an encrypted journal, an AI recovery companion (Arcos), a Help Hub, a content blocker, and an anonymous community with recovery pods. The Service is available as a mobile application for iOS and Android and through the website at hexys.app. Your use of the Service is also governed by our Privacy Policy at hexys.app/privacy, which is incorporated into these Terms by reference.

Age Requirement: Hexys is exclusively for users aged 18 and older. By creating an account, you confirm that you are at least 18 years old. We verify age at onboarding through date of birth verification. Users who do not meet the minimum age requirement will be blocked from creating an account.

2. Subscription Plans

Hexys offers two tiers:

• Free Tier: includes streak tracking, encrypted journal, the Help Hub, and 5 Arcos AI companion messages per day.
• Core Plan ($9.99/month or $59.99/year): includes unlimited Arcos messages, the anonymous community, recovery pods of 5, accountability partners, and the full educational content library.

Auto-renewal of subscriptions. When you purchase a Hexys Core subscription, your subscription will automatically renew at the end of each subscription period until you cancel. The monthly subscription renews monthly at $9.99. The annual subscription renews annually at $59.99. Prices are charged to your App Store or Google Play account at the time of purchase or renewal. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time through your App Store or Google Play account settings on your device. Refer to Apple's and Google's published terms for full details on subscription management. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.

3. User Content and Community Rules

You retain ownership of all content you create within Hexys, including journal entries, community posts, and pod messages. By posting content in the community or pods, you grant Hexys a non-exclusive, worldwide license to display that content to other users within the context of the Service.

Community Rules: The following content is prohibited in community posts and pod messages:

• Illegal content of any kind
• Identifying information about others (real names, photos, contact information)
• Child sexual abuse material (CSAM). Any detection results in immediate account termination and a report to the National Center for Missing and Exploited Children (NCMEC).
• Explicit sexual content, pornographic imagery, or links to adult content
• Harassment, threats, or targeted abuse of other users
• Spam or commercial solicitation

4. Content Moderation

All community posts are subject to AI pre-publish review. Posts that are flagged by AI moderation are held for human review before being published. Posts that contain potential crisis indicators (such as self-harm or suicidal ideation) trigger crisis detection, and the user is provided with relevant crisis resources including the 988 Suicide and Crisis Lifeline.

We reserve the right to remove any content that violates these Terms or our Community Rules. Repeated violations may result in account suspension or termination.

5. Arcos AI Companion

Arcos is an AI recovery companion powered by Anthropic's Claude. Arcos is not a licensed therapist, counselor, or medical provider. Conversations with Arcos do not constitute medical advice, diagnosis, or treatment. Arcos is a self-directed support tool and should not be used as a substitute for professional mental health care.

Conversations with Arcos are stored server-side to enable context across sessions. Arcos does not have access to your journal entries unless you explicitly share content from your journal within a conversation. For full details on how Arcos conversation data is handled, see our Privacy Policy at hexys.app/privacy.

If you are experiencing a mental health crisis, do not rely solely on Arcos. Contact the 988 Suicide and Crisis Lifeline (call or text 988) or text HOME to 741741 (Crisis Text Line) immediately.

6. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with any other person
• Scrape, crawl, or otherwise extract data from the Service through automated means
• Attempt to circumvent security measures or access controls
• Use the Service for any purpose other than personal behavioral recovery
• Impersonate another user or create multiple accounts
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to extract harmful, dangerous, illegal, or otherwise prohibited content from Arcos through prompt injection, jailbreaking, manipulation, or any other means. Tailspin Interactive LLC reserves the right to revoke Arcos access or terminate the account of any user who engages in such behavior.

You may delete your Hexys account at any time. For information on how to delete your account and what happens to your data when you do, see the Account Deletion and Data Retention section of our Privacy Policy.

7. Apple App Store Additional Terms

The following terms apply to your use of the Hexys iOS application obtained from the Apple App Store. These terms are required by Apple Inc.

Acknowledgment. You acknowledge that this agreement is between you and Tailspin Interactive LLC (the developer of Hexys), and not with Apple. Apple is not responsible for the Hexys application or its content.

Scope of license. The license granted to you for the Hexys application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and support. Tailspin Interactive LLC is solely responsible for providing any maintenance and support services for the Hexys application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Hexys.

Warranty. Tailspin Interactive LLC is solely responsible for any product warranties for Hexys, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Hexys to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Hexys.

Product claims. Tailspin Interactive LLC, not Apple, is responsible for addressing any claims relating to Hexys or your possession or use of Hexys, including product liability claims, claims that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

Intellectual property rights. In the event of any third-party claim that Hexys or your possession and use of Hexys infringes that third party's intellectual property rights, Tailspin Interactive LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this agreement, and that, upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.

8. Intellectual Property

Hexys and its original content (excluding user-generated content), features, and functionality are owned by Hexys and are protected by international copyright, trademark, and other intellectual property laws. The Hexys name, logo, and all related marks are trademarks of Hexys.

You retain all rights to content you create within the app. Journal entries, which are encrypted on your device, remain your sole property. Community posts you create remain your intellectual property, with a license granted to Hexys to display them within the Service as described in Section 3.

9. Disclaimers

Hexys is not a medical device, therapy service, or mental health treatment. The Service provides educational content and self-directed recovery tools grounded in neuroscience research. Arcos (the AI companion) does not provide medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, contact the 988 Suicide and Crisis Lifeline or your local emergency services.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Hexys and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, goodwill, or other intangible losses, resulting from: (i) your use of or inability to use the Service; (ii) any unauthorized access to or alteration of your data; (iii) any content posted through the Service by other users; or (iv) any other matter relating to the Service.

In no event shall our total liability to you for all claims relating to the Service exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Copyright and DMCA

Designated copyright agent. Tailspin Interactive LLC respects the intellectual property rights of others. If you believe content posted on Hexys (including community posts, pod discussions, or any other user-generated content) infringes your copyright, please send a written notice to our designated copyright agent at copyright@hexys.app containing the following information:

• A physical or electronic signature of the copyright owner or authorized representative
• Identification of the copyrighted work claimed to be infringed
• Identification of the material claimed to be infringing, with sufficient detail to allow us to locate it
• Your contact information (address, phone, email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act.

12. Force Majeure

Tailspin Interactive LLC will not be liable for any failure or delay in performing our obligations under these Terms when such failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, government actions, labor disputes, internet service provider outages, third-party service failures (including outages affecting Apple, Google, Amazon Web Services, Supabase, RevenueCat, or other infrastructure providers), and pandemic-related disruptions.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or via email. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
